Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Sea Shell Identifier mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By downloading, installing, or using Sea Shell Identifier, you agree to these Terms of Use and our Privacy Policy. These Terms constitute a legally binding agreement between you and Sea Shell Identifier.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your iOS device
• Use the App for personal, non-commercial purposes
• Access features and services provided within the App

3. User Accounts and Subscriptions

3.1 Free Access

The App provides limited free scans for seashell identification. Free users receive 3 initial scans and can earn additional scans through in-app actions.

3.2 Premium Subscription

Premium subscriptions are available through Apple's In-App Purchase system:

• Weekly Plan: Includes 3-day free trial, then charged weekly
• Monthly Plan: Charged monthly with no trial
• Yearly Plan: Charged annually with no trial

3.3 Subscription Terms

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Payment will be charged to your Apple ID account at confirmation of purchase
• You can manage and cancel subscriptions through your Apple ID Account Settings
• No refunds for partial subscription periods
• Free trial periods (where offered) forfeit any unused portion upon purchase

4. User Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the App's servers or networks
• Use automated systems or bots to access the App
• Share your subscription access with others
• Misrepresent your identity or affiliation
• Violate any applicable laws or regulations

5. Intellectual Property

All content, features, and functionality of the App, including but not limited to:

• AI models and algorithms
• Species database and identification data
• Text, graphics, logos, and images
• Software code and architecture

are owned by Sea Shell Identifier and protected by copyright, trademark, and other intellectual property laws.

6. User-Generated Content

6.1 Photos and Collection Data

You retain ownership of photos you upload. By using the App, you grant us a license to:

• Process your photos through our AI identification system
• Use anonymized data to improve our AI models
• Store your collection data locally on your device

6.2 Your Responsibility

You are solely responsible for the content you upload and must ensure you have the right to upload such content.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy of seashell identification results
• Uninterrupted or error-free operation
• Fitness for a particular purpose
• Non-infringement

Educational Use Only: Sea Shell Identifier is designed for educational and recreational purposes. Identification results should not be solely relied upon for scientific, commercial, or critical decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEA SHELL IDENTIFIER SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, or profits
• Errors in identification results
• Service interruptions or downtime

Our total liability shall not exceed the amount you paid for the App subscription in the past 12 months.

9. Modifications to the App

We reserve the right to:

• Modify, suspend, or discontinue any feature of the App
• Update pricing for future subscriptions
• Change these Terms at any time (changes will be effective upon posting)

Continued use of the App after changes constitutes acceptance of the new Terms.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for:

• Breach of these Terms
• Fraudulent or illegal activity
• Extended period of inactivity

You may terminate your use at any time by deleting the App and cancelling your subscription.

11. Third-Party Services

The App integrates with third-party services including:

• Apple App Store and In-App Purchase system
• RevenueCat for subscription management
• AI service providers for image recognition

Your use of these services is subject to their respective terms and conditions.

12. Geographic Restrictions

The App is intended for users worldwide but may not be available in all countries or regions. You are responsible for compliance with local laws and regulations.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Turkey.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sea Shell Identifier regarding the use of the App.
